13. WhatsApp Marketing — The Service
SoftTechLab WhatsApp Marketing is software that connects to your own WhatsApp Business account on Meta's WhatsApp Business Platform (Cloud API). You supply your own Meta Business account, your own WhatsApp Business numbers and your own API credentials; we do not provide, resell or lease WhatsApp numbers, and we are not a party to your relationship with Meta.
The platform lets you store contacts, build message templates for Meta's approval, send campaigns from your connected numbers, receive and reply to messages in a shared inbox, manage a lead pipeline, and read delivery and engagement reporting. Message templates must be approved by Meta before they can be sent; approval is Meta's decision and not ours.
Your Meta account governs your messaging. Meta's WhatsApp Business Messaging Policy, Commerce Policy and quality ratings apply to your numbers directly. Meta may rate-limit, restrict or disable a number for reasons entirely outside our control, and we cannot reverse such a decision on your behalf.
14. Free Trial
Each account may start one free trial of WhatsApp Marketing, lasting 7 days from the moment it is started. A trial cannot be started a second time, and it is not restarted by subscribing or by later cancelling.
During the trial the account may hold up to 500 contacts and 100 MB of stored media. These limits are enforced by the server.
No payment details are required to start a trial, and nothing is charged automatically when it ends. When the trial expires, the ability to add contacts, upload media, connect further numbers and send campaigns stops until you subscribe.
15. WhatsApp Marketing Subscription, Renewal and Expiry
What the subscription includes: a one-month platform subscription allowing up to 50,000 contacts and 1 GB of stored media, across up to 5 connected WhatsApp numbers. Current prices are shown on the plan page before payment.
Renewal is manual. There is no automatic recurring billing and no stored card. Your access ends on its expiry date unless you choose to pay again. If you renew before the current period ends, the new month is added to the time remaining rather than replacing it.
On expiry the account becomes read-only for the functions that consume the plan: you can still sign in, read your contacts, leads, campaigns and conversations, and export your data, but you cannot add contacts, upload media, connect numbers or send campaigns until you renew.
Data retention after expiry: nothing is deleted automatically when a subscription or trial ends. We intend to keep your WhatsApp Marketing data for at least 30 days after expiry so that renewing restores your account as you left it. After that period the data may be deleted. We will not guarantee recovery of data belonging to an account that has been expired for more than 30 days, so please export anything you need before then.
16. Meta / WhatsApp API Charges Are Separate
The subscription fee is a platform fee for the software only. It does not include, and is not a prepayment towards, the charges Meta makes for sending messages on the WhatsApp Business Platform.
Meta bills message charges directly to your own Meta Business account, at Meta's own rates, and you pay them to Meta. SoftTechLab does not collect these charges, does not add a markup to them, and does not receive any share of them.
The platform shows estimated Meta costs as a convenience. Those figures are estimates based on published rates and the messages we recorded as delivered; they are not an invoice and may differ from what Meta actually bills. Meta's rates, rate categories and billing rules can change at any time without notice to us. Always treat your Meta billing dashboard as authoritative.
17. Recipient Consent and Lawful Messaging
You are solely responsible for having a lawful basis to message every person you upload. You confirm that the phone numbers you import were collected by you, with the consent required by the laws that apply to you and to your recipients, and in line with Meta's policies.
You are responsible for honouring opt-out requests promptly. The platform includes tools to help — configurable opt-out phrases, an automatic suppression list, and exclusion of opted-out and undeliverable numbers from campaign audiences — but these are aids, not a substitute for your own compliance. Using them does not transfer responsibility to us.
We do not purchase, supply, rent or validate contact lists, and we do not review the content of your messages before they are sent. You are the sender of every message that leaves your connected numbers.
You are responsible for any notice or consent your recipients are owed about your use of a third-party platform to process their data, and for responding to requests those recipients make to you about their data.
18. Acceptable Use, Suspension and Termination
In addition to the prohibited activities above, you must not use WhatsApp Marketing to:
- Send unsolicited bulk messages, or message people who have not agreed to hear from you.
- Continue messaging anyone who has asked you to stop, by any means.
- Send content that is unlawful, fraudulent, deceptive, harassing, hateful, or that impersonates another person or business.
- Upload contact lists you bought, scraped, or otherwise obtained without the recipients' consent.
- Send anything prohibited by Meta's WhatsApp Business Messaging Policy or Commerce Policy.
- Share one subscription across separate businesses, or resell access to the platform.
- Attempt to bypass the contact limit, media limit, subscription state or any other restriction, whether by interfering with the interface, calling the API directly, or creating multiple accounts for the same business.
- Probe, scan or test the security of the platform, or attempt to reach data belonging to another customer.
We may suspend or terminate access to WhatsApp Marketing where we reasonably believe these terms have been breached, where Meta or a payment provider requires it, or where continued use presents a legal or security risk. Where circumstances reasonably allow, we will tell you why and give you an opportunity to put it right. Suspension for a breach does not entitle you to a refund of the platform fee.
You may stop using the service at any time by not renewing. See the Refund & Cancellation Policy.
